General terms and conditions of use

The Subdirectorate General of Information Systems and Communications for Security (hereinafter SGSICS) of the Secretariat of State for Security (hereinafter the owner body), whose formal postal address is located at Calle Amador de los Ríos, 2, 28010, Madrid, is the body of the General Administration of the State (Owner), responsible for the development, management, maintenance and administration of the website alertocops.ses.mir.es and the AlertCops Mobility Application (hereinafter, jointly referred to as AlertCops ).

The main purpose of AlertCops is to improve and facilitate access to certain public citizen security services, so that anyone, regardless of their language, origin, or hearing or voice disabilities, can report to the State Security Forces (Police and Civil Guard) an alert, information, data, or news about a criminal act or security incident of which they are a victim or witness.

To this end, this document is made available to interested parties in order to comply with the obligations arising from Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations (hereinafter LPAC), in Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and the free circulation of these data (hereinafter RGPD), Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (hereinafter LOPDGDD) and, subsidiarily, Organic Law 7/2021, of May 26, on the protection of personal data processed for the purposes of prevention, detection, investigation and prosecution of criminal offenses and the execution of criminal penalties, as well as to inform them about the conditions of use of technological resources.

These Terms and Conditions constitute a binding agreement between you, whether personally or on behalf of an entity ("you"), and the owner of the Services, relating to your access to and use of the Services. You agree that, by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. If you do not agree to all of these Legal Terms, you may not use the Services and should discontinue use immediately.

We recommend that you print a copy of these Legal Terms for your records.

The object of the conditions: AlertCops

The purpose of these General Terms of Use (hereinafter, Terms) is to regulate access to and use of the application. For the purposes of these terms, AlertCops shall be understood to mean the external appearance of the screen interfaces, both static and dynamic, i.e., the navigation tree; and all elements integrated into both the screen interfaces and the navigation tree (hereinafter, Contents) and all online services or resources that may be offered to the interested party (hereinafter, Services).

The Owner reserves the right to modify, at any time and without prior notice, the presentation and configuration of AlertCops and the Content and Services incorporated therein. The interested party acknowledges and accepts that any of these elements that are part of AlertCops , or access to them, may be interrupted, deactivated, and/or canceled at any time.

The interested person

Access to and/or use of AlertCops is entirely voluntary and confers upon the user the status of data subject. Data subjects accept, from the moment of access, without reservation, the content of these instructions and requirements, as well as, where applicable, any specific conditions or instructions that may complement, replace, or modify them in any way, in relation to the AlertCops Services and Content. Consequently, data subjects must carefully read all conditions before accessing and using any AlertCops service , which will be their sole responsibility.

Access to AlertCops is free and, as a general rule, free of charge. The interested party does not have to provide any compensation to enjoy it, except for the cost of connection through the telecommunications network provided by the access provider they have contracted.

AlertCops is primarily aimed at interested parties located in Spain. The Owner does not guarantee that AlertCops complies with the laws of other countries, either in whole or in part. If you reside or are domiciled elsewhere and decide to access and/or browse AlertCops , you do so at your own risk. You must ensure that such access and browsing complies with applicable local legislation. The Secretariat of State for Security assumes no liability that may arise from such access.

Access and use

Please note that both access and use of AlertCops and all subdomains and directories included therein, as well as any Services or Content that may be obtained through it, are subject to the terms detailed in this document.

This body will do everything possible to ensure the proper functioning and security of user data handled by AlertCops ; however, it is not responsible for, nor does it guarantee, that access to the service will be uninterrupted or error-free.

Nor does it assume any responsibility or guarantee that the content or software that may be accessed through AlertCops is error-free or will cause damage to the data subject's computer system (software and hardware). Under no circumstances will the State Secretariat for Security be liable for any loss, damage, or harm of any kind arising from access to, browsing in, and use of AlertCops , including, but not limited to, those caused to computer systems or those caused by the introduction of viruses.

It is also not responsible for any damages that may be caused to the interested party due to improper use of AlertCops . In particular, it is not responsible in any way for any telecommunications outages, interruptions, failures, or defects that may occur.

Likewise, it reserves the right to eliminate, limit or prevent access to AlertCops or its functionalities and/or to deactivate passwords, and in general, to proceed to block them , for objectively justified reasons related to the security adopted for the correct functioning of AlertCops or its functionalities and/or the suspicion of unauthorized or fraudulent use of them.

If you do not agree with the considerations detailed in this document, do not use AlertCops . Any use you make of it or of the services and content included herein will imply express acceptance of the legal terms contained in this text. In accordance with the provisions of Article 3 of the LPAC (Spanish Civil Code) and Article 7 of Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights, which regulates consent for the processing of data of minors, minors under the age of 14 may not access the AlertCops application without the consent and assistance of their parents, guardians, or legal representatives.

Modifications to its content

The owner reserves the right to make changes to AlertCops at any time and without prior notice, in order to modify, correct, update, add, or delete any of its content, structure, design, services, or access conditions.

Every effort will be made to prevent errors and/or alterations that impede the correct use of the service. Should they occur, they will be repaired or updated as soon as possible. We cannot guarantee their absence or that all information provided is constantly updated.

The information and services offered are updated periodically. Because the information is not updated immediately, you should check its validity and accuracy.

The terms and conditions contained in this document may change without prior notice or communication, so we invite you to review them when you visit AlertCops again .

We will notify you of any changes by updating the "Last Updated" date of these Legal Terms. You waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in the revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.

ALERTCOPS SERVICES

AlertCops mobility application , the interested person can notify the Emergency Management Centers of the State Security Forces and Corps (National Police and Civil Guard) of any insecurity or emergency situations included in the situations predefined in the AlertCops system .

The notification will be processed and delivered to the State Security Forces responsible for the area where it is located. They will receive notifications of any status changes for the person who sent it.

The Emergency Management Center of the police force responsible for handling the alert will be provided with the personal and health information that the interested party has voluntarily provided for better service provision, in addition to the geolocation of the device from which the alert is generated, if this service is available, and the multimedia files that the interested party has contributed to the alert.

Likewise, the Emergency Management Center of the competent police station may contact the person designated by the interested party as a contact person, if necessary, to resolve the situation.

This is an additional channel for citizen service by the State Security Forces (National Police and Civil Guard), allowing them to continue using the usual channels as they have done up until now.

AlertCops application incorporates the following functionalities:

Sending photos and videos. Registered interested parties may send photos and videos associated with an issued alert directly from their mobile devices to the State Security Forces' emergency management centers. These multimedia elements may be incorporated into any police, administrative, and judicial actions that may arise as a result of the issued alert.

Tracking active alerts. When the data subject submits an alert through the AlertCops app , they will have the option to have the mobile app periodically send their position for the duration of the alert's active status. To do so, the data subject must specifically enable this option when submitting the alert. The data subject's position will be represented in the Geographic Information System (GIS) of the corresponding law enforcement agency's Emergency Management Center. To activate the active alert tracking option, the data subject must enable geolocation services in the AlertCops app on their mobile device.

Geo-located alerts

This feature allows you to define specific alerts linked to a geographic area. In this case, when you access an area where a geolocated alert is activated, the AlertCops app's alert screen will be updated to include the area-specific alert, along with the rest of the alerts. This way, if this specific alert is activated, it will be forwarded directly to the emergency management center specifically designated for processing.

These types of alerts will be available in a specific area and only in that area. They can be activated for a set period of time, after which they will permanently disappear from the alerts screen. To receive these types of alerts, you must have geolocation services enabled in the app on your mobile device.

Help or information (on main screen)

From this menu, users can report a situation of risk or concern related to public safety. Calls can be made to the National Police's 091 number and the Civil Guard's 062 number, or they can open a chat with the corresponding police force. If you are in the Basque Country or Catalonia, please call 112.

Users can also view personalized information cards of interest issued by State Security Forces or emergency centers. The categories for which users can request help or information include harassment, assault or fighting, domestic violence, sexual violence, hate crimes, illegal occupation, and noise and disturbances.

Citizen Service (Police Stations and Barracks)

The "Citizen Assistance" feature is designed to assist users by providing accurate and accessible information about the police stations belonging to the State Security Forces (National Police and Civil Guard) closest to their location. Using an interactive map integrated into the app, users can quickly and easily identify the location of available police facilities in their area, saving them time and getting the help they need more quickly.

In addition to the geographic location of police stations, the feature includes additional relevant information, such as the corresponding contact information. This allows users to communicate directly with the appropriate authority to ask questions, report incidents, or request assistance in any situation.

Location Sharing Feature

With the Location Sharing feature, the AlertCops app allows the location of the person concerned to be shared with a third party (emergency contacts or trusted contacts). This service can only be used if both people have the AlertCops app installed on their mobile devices. Within the service, two situations can occur: both people agree to share their location with the other contact (a request is received in the app on both users' devices), or one person agrees to share and the other does not.

To share your location, you must select the person from your contact list. The emergency contact is also asked to share their location with the person concerned; they can expressly accept or reject this request. At this point, a "relationship" is created between the person concerned and the trusted contact.

All alerts configured in the Geo-Located Alerts service that the data subject configures in AlertCops will be notified to their emergency contact, with no option for the data subject to prevent any alerts from being sent to them. Once both mobile phones are linked as the emergency contact and the data subject, respectively, the trusted contact will be able to view the data subject's location in the AlertCops application , provided that the data subject expressly indicates otherwise.

At any time, the data subject may deactivate this option. Under this setting, no Law Enforcement Emergency Management Center will be able to view the data subject's location.

To enable Location Sharing, you must have geolocation services enabled in the AlertCops app on your mobile device.

Guardian Function

With the Guardian feature, the AlertCops app allows the affected person's location to be forwarded to a special device responsible for protecting public safety (Guardian). In this feature, the affected person must select a Guardian from among the available Law Enforcement Emergency Management Centers. This center will then be able to view the affected person's location registered with them.

The Guardian service allows State Security Forces and emergency centers to publish a location service in specific circumstances, such as an event, where citizens can subscribe to send their position periodically throughout the event.

The interested party may activate or deactivate this display option at any time by the public guardian. The Law Enforcement Emergency Management Center responding to the alert may deactivate this feature when it is unable to provide the public guardian service, and in any case, when the device has left the geographic area in which the service is provided. To activate the Guardian function, geolocation services must be enabled in the AlertCops app on your mobile device.

Accompany Me Function

'Accompany Me' is a service designed to improve the safety of users while engaging in activities or on routes. This feature allows SMS messages to be automatically sent to emergency contacts previously designated by the user, providing relevant information such as their location at the beginning and end of the established period. This ensures that the emergency contacts selected by the user can be informed of their location during the activity and provide assistance if necessary.

The service offers the option to activate "no coverage mode," a feature that allows the person concerned to be located by rescue services even in the absence of mobile network coverage. This mechanism is intended to provide additional support in situations where the person concerned requires immediate assistance and cannot communicate through conventional means.

SOS Button Function

This feature can be used by any citizen and is primarily intended to strengthen the protection of at-risk groups. Users will be able to add the AlertCops widget to their mobile device's home screen, making it as easy and simple to access and use as possible.

In case of emergency, in the event of a risky situation, the person concerned must press the "SOS button" five times in less than six seconds. The system will automatically and immediately, unattended and discreetly, send an SOS alert to the emergency management center of the Law Enforcement Forces corresponding to the location where they are located.

Additionally, 10 seconds of audio will be recorded and sent as an attachment to the alert so the center can assess its handling of the alert received.

If the user belongs to a risk group, they must identify themselves as belonging to one of these groups, indicating the group to which they belong and their group code, and accepting these terms of use. This will allow them to receive more personalized attention tailored to their needs.

Simulated Call Function

The 'Simulated Call' feature is offered as a self-protection tool designed to allow the user to generate a fictitious call for deterrence or support purposes in risky situations.

To set up this feature, the interested party must enter the name they want to appear on their mobile device screen, select the "Now" option, or schedule the call at a specific time using the corresponding button.

AlertCops call screen overlayed on other apps. Once granted, the call will be scheduled, allowing the user to view the name and time of the call, as well as the option to cancel it before it occurs. This feature is intended to provide the user with an additional personal safety resource.

Audible Alarm Function

The 'Audible Alarm' feature is offered as a self-protection mechanism designed to assist the interested party in situations where their safety or personal integrity may be compromised.

This system is intended to help the user react immediately to potential threats or dangers by generating an audible alert and intermittently activating the camera's flash, which can serve to alert people around them to the need for help or the presence of an emergency.

The 'Sound Alarm' is designed to be a useful tool in a variety of circumstances, such as when the user feels threatened, is in a risky situation, or needs to urgently communicate their vulnerability. Its use is intended to promote a safer and more aware environment for the user and those around them.

Rescue Function

'Rescue' is a service designed to facilitate locating a user in emergency situations, even in the absence of mobile network coverage. This service uses the device's Wi -Fi technology to locate the user.

If a user without coverage accesses the AlertCops app , a screen will appear notifying them of the lack of connection and offering various options, including the ability to call emergency services and access the "Rescue" feature. This tool aims to provide an additional safety resource to ensure assistance in critical circumstances.

Notices, Settings and Help

AlertCops app features a menu for receiving and viewing all alerts and notifications related to the app and public safety.

Notifications are received in specific areas and may include a photograph attached to illustrate the notice.

These notifications and alerts can be configured in the "Settings" menu. Within this menu, in the "Notices and Alerts" section, users can configure the communications they receive from the app. Security notifications correspond to emergency communications, citizen collaboration, or general interest, depending on the area.

In the "Settings" menu, you can also configure the "SOS Button" if you haven't done so during the installation process. You can also add "Emergency Contacts," validate your membership in the healthcare or gender-based violence group (in the "Group" section), and modify your profile and language. You can also create an account to recover emergency contact information, alerts, and settings if you delete AlertCops .

Finally, AlertCops Through its "Help" menu, it offers the option of directly contacting AlertCops support . To do so, the user must enter an email address and write a message in the corresponding field. The support team should respond as quickly as possible.

In the "Frequently Asked Questions" section, users can review the most frequently asked questions related to the application and AlertCops features . By browsing, scrolling, or searching in the top bar, they can find answers to their questions. If the answer isn't answered, users can click Contact to go to the previous section and contact support directly.

AlertCops Accessibility Statement and Privacy Policy , can be found in the "Legal Information" section. Upon entering this section, the application redirects the user to the owner's website, where they can find the document they are looking for.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

Intellectual property

The General Administration of the State (Ministry of the Interior-Secretary of State for Security), unless otherwise indicated (hereinafter Holder), is the owner or the licensee of all intellectual property rights in and to the Services provided by AlertCops , including all source code, databases, functionality, software, website and mobile application designs, audio, video, text, photographs, and graphics on the Services (collectively, the "Content"), as well as the branding and logos contained therein (the "Marks").

The unauthorized reproduction, distribution, commercialization, or transformation of these works, except for personal and private use, constitutes an infringement of their intellectual property rights. All distinctive signs and trademarks of any kind contained in this application are the property of the interested parties and are reserved by law.

The unauthorized placement of information contained in AlertCops , as well as any damage caused to the intellectual and industrial property rights of the owner, may give rise to the exercise of the corresponding legal actions, and where appropriate, to the liabilities arising from said exercise.

Use of AlertCops Services

Except as provided in this section or elsewhere in these Terms and Conditions, no part of the Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any purpose whatsoever, without the express prior written permission of the Owner.

If you wish to make any use of the Services, Content or Marks other than as set forth in this section or elsewhere in the Legal Terms, you must contact us. request to alertcops@interior.es. If you are granted permission to publicly post, reproduce, or display any part of the AlertCops Services or Content , you must identify the Owner as the owner of the Services, Content, or Marks and ensure that any copyright or other proprietary notices appear or are conspicuous when posting, reproducing, or displaying the AlertCops Content.

The Owner reserves all rights not expressly granted in and to the Services, Content, and Trademarks.

Any breach of these Intellectual Property Rights will constitute a material breach of the Terms and Conditions of this document.

Presentations and contributions

The interested person must review Please read this section and the "PROHIBITED ACTIVITIES" section carefully before using the Services to understand (a) the rights granted to the Holder and (b) the obligations of the interested person when you post or upload any content through the Services.

Shipments : When sending to the Holder directly any questions, comments, suggestions, ideas, feedback or other information about the Services ("Submissions"), the interested party agrees to assign all intellectual property rights in such Submission. The interested party agrees that the Owner will be the owner of the content of this Shipment and has right to its unrestricted use and dissemination for any legal, statistical or application operation purpose, without recognition or compensation to the interested party.

Contributions : Through the Services, the interested person may be invited to chat, or contribute online and other features during which you may create, submit, display, or transmit content and materials directed to Law Enforcement Agencies , including, but not limited to, text, writings, video, audio, photographs, comments, personal information, or other material ("Contributions"). Any Submissions that are posted will also be treated as Contributions.

The user, through a chat, sends an alert or sensitive information they wish to share to law enforcement agencies. Once they receive the alert, they decide whether it contains relevant information to share with citizens in a specific area. The data subject is responsible for the content of their contributions: By submitting contributions through any of the Services, the data subject:

  • confirm that you have read and agree to the terms set out in "PROHIBITED ACTIVITIES" and that you will not post, upload or transmit through the Services any Contributions the content of which is unlawful, harassing, hateful, harmful, defamatory, obscene, intimidating, abusive, discriminatory, threatening to any person or group, sexually explicit, false, inaccurate, deceptive or misleading;
  • You warrant that such contributions are not the result of your own invention, nor do you intend to confuse, unnecessarily alert (with false alerts), or intentionally overload the Services with your Submissions and/or Contributions; and
  • warrants and represents that your Submissions and/or Contributions do not constitute confidential information.

The interested party is solely responsible for his/her Submissions and/or Contributions and expressly accepts any legal and judicial responsibility due to his/her non-compliance with (a) this section, (b) the intellectual property rights of third parties or (c) applicable law.

Deletion or editing of Content : Although there is no obligation on the part of the Owner to supervise any participation, it will have right to remove or edit any contribution at any time without prior notice if, arising from one reasonable opinion, that such Contributions are harmful or violate these Terms of Use. If such Contributions are removed or edited, the person's account may also be suspended or disabled, and the person may be reported to the authorities.

RESPONSIBILITY OF THE PERSON CONCERNED

The interested party agrees to use the services and content provided by AlertCops in accordance with current legislation and the principles of good faith and accepted practices, and not to violate public safety through their actions. Therefore, any use for illegal purposes or that harms, impedes, may damage and/or overload, in any way, the use and normal operation of AlertCops , or that directly or indirectly harms it or any third party, is prohibited.

By using the Services, the interested party declares and guarantees:

(1) the truthfulness, accuracy, updating, completeness and legality of the information provided in the forms issued by the State Secretariat for Security for access to certain content or services offered by the application;

(2) that it will maintain the accuracy of such information and will promptly update such registration information as necessary;

(3) that you have the legal capacity and agree to comply with these Legal Terms;

(4) that the interested party is not a minor in the jurisdiction in which he or she resides, or if a minor, has received his or her parental permission to use the Services;

( 5) that you will not access the Services through automated or non-human means, whether through a bot , script, or otherwise;

(6) that you will not use the information, content and/or Services and data offered by AlertCops for any illegal or unauthorized purpose, or that is contrary to the provisions of these Conditions, applicable Laws or regulations, morality or public order, or that in any other way may imply injury to the rights of third parties or the operation of the application itself.

If the data subject provides false, inaccurate, outdated or incomplete information, or if the data subject misuses the information recorded in such forms, such as, but not limited to, theft, loss, or unauthorized access to identifiers and/or passwords, the AlertCops application will inform the competent authority about this fact and the Owner will proceed to suspend or cancel his/her account and refuse all current or future use of the Services (or any part thereof).

The interested party shall be solely responsible for their use of AlertCops and for complying with these general conditions in their entirety. Consequently, they undertake to safeguard and not disclose, as personal information, any access codes, passwords, or similar data assigned to access any service. They shall be directly or indirectly liable for any damages of any kind arising from misuse by themselves or by third parties, including those resulting from their negligence. AlertCops , its responsible body, and the managing bodies or units shall be liable for all damages and losses, as well as any damages that may be incurred.

Any violation of these general conditions may give rise to any legal or extrajudicial action that may be appropriate against the interested party.

VALIDATION OF USERS

To use AlertCops services , the interested party must have a mobile phone and enter their phone number into the app. Once they enter their number, they will receive a text message (SMS) with information to verify that they are who they claim to be. They must enter this information into the app and choose a username. Once this process is complete, they can begin using AlertCops services .

The data subject is responsible for all use of his or her account. The Owner reserves the right to remove, reclaim, or change a username he or she selects if it determines that such username is inappropriate, obscene, or objectionable.

PROHIBITED ACTIVITIES

AlertCops user undertakes to use the application ( app ) diligently, correctly, and lawfully, and may not access or use the Services for any purpose other than that for which the owner makes the Services available; consequently, as a user of the Services, the data subject undertakes to:

  • AlertCops information .
  • Not to recover, reproduce, distribute, transmit, adapt or modify, by any means and in any form, the contents of AlertCops (texts, designs, graphics, information, databases , sound and/or image files, logos...) and other elements of this site, except with the prior authorization of the owner or when permitted by law , under any circumstances, in particular, to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from the Owner.
  • Not to make any commercial or advertising use of the aforementioned content other than that strictly permitted, where applicable, and not to infringe, in general, any rights derived from the same.
  • Do not circumvent, disable, or otherwise interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services and/or the content contained therein.
  • Do not engage in unauthorized framing of or linking to the Services.
  • Do not misuse our support services or submit false notices and/or alerts .
  • Do not engage in any automated use of the system, such as using scripts to send comments or messages, or using data mining, robots, or similar data gathering and extraction tools.
  • Not to interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
  • Do not attempt to impersonate another user or person or use another user's username.
  • Do not use any information obtained from the Services to harass, abuse, or harm another person.
  • Except as permitted by applicable law, no decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.
  • Do not attempt to circumvent any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.
  • Not to harass, annoy, intimidate, or threaten any of our employees or agents involved in providing any part of the Services.
  • Not to remove the copyright or other proprietary rights notice from any Content.
  • Do not copy or adapt the Services software.
  • Do not upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
  • Do not attempt to test the vulnerability of any system or network of the State Secretariat for Security or the State Security Forces and Corps (National Police or Civil Guard) or violate any security or authentication measures.
  • Except as may be the result of standard search engine or Internet browser usage, you will not use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or using or launching any unauthorized script or other software.
  • Not to disparage, tarnish, or damage, in our opinion, us and/or the Services.

Do not use the contents of AlertCops for purposes or with effects contrary to the law, morality, generally accepted good customs, or public order.

USER-GENERATED CONTRIBUTIONS

AlertCops Services may invite you to chat, contribute, or participate in other features, and may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Services, including, but not limited to, text, writings, video, audio, photographs, comments, suggestions, or personal information or other material (collectively, "Contributions"). Contributions may be viewable by other users of the Services. As such, any Contributions you transmit may be treated as non-confidential and non-proprietary. When you create or make available any Contribution, you represent and warrant that:

  • The creation, distribution, transmission, public display or performance, and the accessing, downloading or copying of your Contributions do not and will not infringe any proprietary or other legal or regulatory rights, and are not invented (are not false, inaccurate or misleading) and are not intended to undermine the proper operation of the Services.
  • Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
  • Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, defamatory, slanderous, or otherwise objectionable (as determined by us).
  • Your Contributions do not ridicule, mock, belittle, intimidate, or abuse anyone.
  • Your Contributions do not advocate the violent overthrow of any government or incite, encourage, or threaten physical harm against another person.
  • Your Contributions do not violate any applicable law, regulation, or rule.
  • Your Contributions do not violate the privacy or publicity rights of any third party.
  • Your Contributions do not violate any applicable law concerning child pornography, nor are they intended to protect the health or well-being of minors.
  • Your Contributions do not include any offensive comments that are related to race, national origin, gender, sexual preference, or physical disability.
  • Your Contributions do not violate, or link to material that violates, any provision of these Terms or any applicable law or regulation.

Any use of the Services in violation of the foregoing violates these Terms and may result in, among other things, termination or suspension of your rights to use the Services.

Links Policy

The conditions that interested parties must meet to establish a hyperlink between their website and/or their Mobile Application (App) with AlertCops are the following:

  • Hyperlinking is permitted only under the conditions provided herein.

The technical availability, accuracy, truthfulness, validity, or legality of third-party sites that may be accessed through links is not guaranteed.

The State Secretariat for Security will not, under any circumstances, review or control the content of other websites, nor does it approve, examine, or endorse the products and services, content, files, and any other material found on such linked sites.

Finally , it should be noted that this organization assumes no responsibility for any damages that may arise from access to, use of, the quality or legality of the content, communications, opinions, products and services of websites not managed by the State Secretariat for Security and that are linked to in AlertCops.

EXCLUSION OF WARRANTIES AND LIABILITY

The owner (and its dependent bodies) do not claim any ownership over the Contributions of the interested party. The interested party retains full ownership of all of its Contributions and any intellectual property rights or other proprietary rights associated with them. Therefore, the owner (and its dependent bodies) do not guarantee or accept liability, under any circumstances, for the following facts and content, or for any damages that may arise from them:

  • No statements or representations in your Contributions provided by the person concerned in any area of the Services.
  • Lack of availability, continuity, access, maintenance, and effective operation of AlertCops and/or its services, and the updating, accuracy, completeness, relevance, timeliness, and reliability of its content, regardless of the cause, and any technical or other difficulties or problems that may give rise to such events.
  • The transmission and/or existence of viruses, other elements or programs that are harmful to the equipment of the interested parties and that could affect them as a result of accessing, using or examining the site, or that could cause alterations to their electronic documents or files.
  • From the illicit, negligent, fraudulent use, impersonating a third party or contrary to the content of these general conditions, good faith, generally accepted uses or public safety, of AlertCops , its services and contents, by interested parties.
  • Of any violations or infringements by third parties of current laws, customs, or practices regarding intellectual property rights, industrial property rights, trade or contractual secrets, privacy rights, honor, image, property, publicity, or competition rights, among others, of third parties.
  • Vices or defects in the contents and/or services accessed through AlertCops .
  • For the reception, storage, obtaining, dissemination or transmission by interested parties of the contents of AlertCops .
  • For the knowledge of any information that unauthorized third parties may possess or use, as well as the characteristics and circumstances of the use of AlertCops content and services by interested parties.

The above list is merely illustrative and not exhaustive, and is, in no case, exclusive or exclusive in any of its points. SERVICE MANAGEMENT

The Owner reserves the right, but not the obligation, to: (1) monitor the Services for violations of these Terms; (2) take appropriate legal action against anyone who, in the Owner's sole discretion, violates the law or these Terms, including, but not limited to, reporting the Services to the Owner. from such user to the competent authorities; (3) in the Owner's sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of the Contributions or any part thereof; (4) in the Owner's sole discretion and without limitation, notice, or liability, to remove from the Services or disable all files and content that are excessive in size or are in any way burdensome to the systems through which the service is provided; and (5) to manage the Services in a manner designed to protect rights and property and to facilitate the proper functioning of the Services.

DAMAGES

Access to AlertCops , as well as any use that may be made of the information it contains, are the sole responsibility of the interested party. The State Secretariat for Security shall not be liable for any consequences, damages, or losses that may arise from this access or use of the information, with the exception of all actions resulting from the application of legal provisions to which the strict exercise of its powers must be subject. Nor can it guarantee that access will not be interrupted or that the content or software that may be accessed will be error-free.

This body is not responsible for any damages that may be caused to interested parties due to the use of the information contained in AlertCops. in relation to the adoption of decisions on the initiation, processing or resolution of administrative or judicial proceedings.

In order to avoid undesirable effects, such information must be verified with the competent Units, Centers, or Organizations or with State Security Forces and Corps (National Police or Civil Guard). In the event of a contradiction between the information provided through AlertCops and that displayed by the competent Units, Centers, or Organizations or with State Security Forces and Corps (National Police or Civil Guard), the latter shall prevail in all cases. Furthermore, the State Secretariat for Security is not responsible, under any circumstances, for the consequences that may arise from the use by the interested party of information provided that proves to be erroneous.

In any case, the information and content of AlertCops may not be used in disputes with the Public Administration, and no liability is assumed for any discrepancies that may exist between the information and content offered by the competent body and the electronic publication that takes place in this application.

CONTINUITY IN SERVICE PROVISION

In accordance with the provisions of the LPAC and Article 11 of Law 34/2002, of July 11, on information society services and electronic commerce, when a competent body has ordered, in exercise of the powers legally attributed to it, the interruption of the provision of an information society service or the withdrawal of certain content from providers established in Spain, and for this purpose the collaboration of the providers of intermediation services is necessary, said body may order the aforementioned providers to suspend the corresponding intermediation service used for the provision of the information society service or the content whose interruption or withdrawal has been ordered respectively.

For its part, in accordance with the provisions of the LPAC itself and Law 40/2015, of October 1, on the Legal Regime of the Public Sector (hereinafter LRJSP), which in its article 34, section one, establishes that damages arising from facts or circumstances that could not have been foreseen or avoided according to the state of knowledge of science or technology existing at the time of their production will not be compensable, all of this without prejudice to the assistance or economic benefits that the laws may establish for these cases.

FALSE COMPLAINT

This document also informs you that articles 456 and 457 of Organic Law 10/1995, of November 23, of the Penal Code, punish with prison sentences or fines those who, knowingly false or with reckless disregard for the truth, impute to any person facts that, if true, would constitute a criminal offense, if this imputation were made before a judicial or administrative official who has the duty to proceed with its investigation, as well as those who, before said officials, pretend to be responsible for or the victim of a criminal offense or report a non-existent one.

USER DATA

The Owner retains certain data that the Data Subject transmits to the Services for the purpose of managing the performance of the Services, as well as data relating to the Data Subject's use of the Services.
